This Privacy Policy and Terms of Use ("Terms") apply to the Jason Aguirre Group website at jasonaguirregroup.company and its tools — including our home-loan application, home-value estimates, and offer forms — to the Jason Aguirre Group mobile application, to lead forms you submit through our ads on platforms such as TikTok and Facebook, and to text messages and social media messages you exchange with us or our AI assistant (together, the "App"). The App is provided by Jason Aguirre, a licensed Texas real estate agent with eXp Realty, LLC ("we," "us," or "our"). By using the App, you agree to this Policy and these Terms.

The App lets you prepare a home offer, request a home-value estimate, start a home-loan pre-qualification application, and contact us. Depending on what you choose to do, you may provide:
Free accounts. You can use most of the App without an account. If you create a free account (you sign in with a code we email you — no password), we store your name, email, phone number, language, saved homes, saved searches, and alert settings, along with the homes you view and search while signed in. We use this to send you alerts and recommendations and so the Jason Aguirre Group agent assigned to you can help you.
Offers and home-value estimates you create are saved locally on your device so you can review them later. This information stays on your device and is not sent to us unless you choose to email or submit it. You can delete it at any time inside the App, or by deleting the App.
We do not sell your personal information. We share it only as needed to provide the features you use:
These providers process the information only to deliver their service. We encourage you to review RentCast's, Web3Forms', and Komoot's own privacy practices.
When you give us your mobile number and agree to receive texts, we use it only to send you the messages you agreed to receive. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. All of the sharing described above excludes text messaging originator opt-in data and consent; this information will not be shared with any third parties. We may share your SMS opt-in or consent status only with service providers that help us deliver our messages (such as Starling AI and phone carriers), who may not use it for any other purpose.
Message frequency varies. Message and data rates may apply. Reply STOP to any text to opt out, or HELP for help. Carriers are not liable for delayed or undelivered messages.
The App contains no advertising and no third-party trackers. We do not track you across other apps or websites, we do not build advertising profiles, and we do not sell your information. Inside the App, we keep a record of the homes you view, save, and search while you are signed in, and we count when a link our agent sent you is opened, only so our team can help you.
Information you send us (such as an offer or a follow-up request) is kept as long as needed to assist you and to meet our legal and recordkeeping obligations, then deleted or anonymized. Account information is kept until you delete your account or ask us to delete it. Information saved on your device remains until you delete it.
Information is transmitted over encrypted (HTTPS) connections. No method of transmission or storage is 100% secure, but we take reasonable steps to protect your information.
Social Security and ITIN numbers. If you choose to provide a Social Security or ITIN number in our loan application, it is transmitted over an encrypted connection, stored encrypted at rest, and accessible only to authorized members of our team for the purpose of assisting with your loan pre-qualification. It is never included in notification emails, never sold, and never shared except with the lender you ask us to work with. Providing it in the application is optional — you may always share it with our team by phone instead.
The App is intended for adults and is not directed to children under 13. We do not knowingly collect information from children under 13.
We may update this Policy from time to time. Material changes will be reflected by updating the "Last updated" date above.

You must be at least 18 years old to use the App. If you create an account, the information you give us must be accurate and kept up to date, the account is for you alone, and you are responsible for activity under it, including keeping the email address we send sign-in codes to secure. You can delete your account at any time from your account page. Unless you are a real estate professional using the App as described in Section 17, use the App only for your own home search, sale, or financing.
The App helps you search for homes, organize a real estate offer, explore an automated home-value estimate, estimate payments, and talk with our team and AI assistant. It is provided for general informational purposes and is not legal, financial, tax, or appraisal advice.
When you "submit an offer," you are sending us the terms you would like to propose. This is not a binding contract and does not create any agreement to buy or sell. A licensed agent will prepare the official TREC contract, review it with you, and nothing is binding until you sign a written agreement.
Home-value estimates are generated automatically from third-party data and recent nearby sales. They are not an appraisal, a broker price opinion, or a guarantee of value or sale price. Payment and affordability calculators show rough estimates based on the numbers you enter; they are not a Loan Estimate, an offer of credit, or a quote of any rate or payment. For an accurate valuation or loan figures, talk with our team or a licensed lender.
You can request a showing through the App at no cost. Under current MLS rules, we must have a written agreement with you before we tour a home together. That agreement explains how and how much the agent is paid; those terms are negotiable and are not set by law. A showing request is not an agreement to work with us.
We use an artificial-intelligence assistant, provided through Starling AI, to reply to you by text message and by direct message on our TikTok, Instagram, and Facebook accounts. It may introduce itself by a first name as part of our team. It will tell you it is an automated assistant if you ask, and you can ask to speak with a person at any time. The assistant can answer general questions, ask about what you are looking for, send you links (such as our home application), and schedule calls with our team. Like any AI, it can make mistakes, so please confirm important details — such as prices, dates, and appointment times — with a member of our team.
If you message or comment on our TikTok, Instagram, or Facebook accounts, our assistant may reply. Replies to public comments are general and never include your personal or financial information; we will invite you to continue privately. If you share your phone number in a direct message, we will use it for what you asked for (for example, a call you scheduled), and we will text you at that number only with your permission.
You can stop our texts or direct messages at any time by replying STOP, ALTO, or anything that clearly means stop (for example, "no me escribas" or "wrong number"), on any channel. We will confirm once and then stop. Opting out does not affect any transaction you are already working on with us unless you ask.
Our home application is an evaluation to see how we can help you — it does not pull your credit and it is not a loan application, pre-qualification, or pre-approval. Our agents and our AI assistant are not mortgage lenders, do not make credit decisions, and do not set loan terms. We can share general information about programs (for example, down payment assistance or loans for buyers with an ITIN), but only a licensed lender can decide whether you qualify or give you rates, payments, or a Loan Estimate. Any rate or payment you see in the App is for information only. We may recommend a lender we have worked with, and you are always free to choose any lender you want.
If you ask for help in an area we don't serve directly, we may connect you with a licensed real estate agent in your area, who may work with a different brokerage. That agent provides their own services under their own brokerage and license, and any agreement you sign is between you and that agent's brokerage. You don't have to work with any agent we connect you with. You don't pay us for the connection, but we may be paid for it: the agent's brokerage may pay our brokerage, eXp Realty, a referral fee if you buy or sell with that agent, or the agent may pay our affiliate Starling AI for marketing and lead services.
Jason Aguirre also owns Starling AI LLC, the messaging and CRM platform that powers our AI assistant and connects partner agents. If we suggest an affiliated business to you, Jason may benefit financially. You are never required to use an affiliated business to work with us, and you are free to shop for other providers.

You agree not to:
If you are a real estate or lending professional using the App (for example, a Jason Aguirre Group team member or a partner agent sharing homes with clients), you also agree that: you will share client information and homes only with your clients' permission; you will follow fair-housing, privacy, and messaging laws and the MLS rules for the listings you share; and you will not post or communicate offers of buyer-agent compensation through the App.
You keep ownership of what you send us, such as photos, notes, or messages. You give us permission to use it as needed to provide the App and help you, and you confirm you have the right to share it. If you send us ideas or suggestions about the App, we may use them freely without paying you.
The App uses and links to services we don't control, such as listing, mapping, property-data, messaging, and social media providers. Their own terms and privacy policies apply, and we are not responsible for them. If you choose to contact a lender, partner agent, or other provider through the App, your dealings with them are between you and that provider.
The App and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, availability, or fitness for a particular purpose. Listing and third-party data may be incomplete or out of date, and the App may be interrupted or contain errors.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App or reliance on its listings, estimates, AI replies, or other information, and our total liability for any claim about the App is limited to the greater of the amount you paid us for the App in the past 12 months or $100. Some states don't allow these limits, so they may not apply to you. Nothing here limits your rights under a written agreement you sign with our brokerage for real estate services.
If you break these Terms or the law while using the App, and a third party makes a claim against us because of it, you agree to cover our reasonable costs of that claim, including attorneys' fees.
If you believe something in the App infringes your copyright, email hello@jasonaguirregroup.company with your contact information, the work you own, where it appears in the App, a statement of your good-faith belief that the use is not authorized, and your signature. We will review it and remove the material when appropriate.
We may change or stop any part of the App, and we may suspend or close an account that breaks these Terms. We may update these Terms; the "Last updated" date shows when, we will make reasonable efforts to point out material changes, and continuing to use the App after an update means you accept it.
You agree that notices, disclosures, and other communications we send you electronically satisfy any legal requirement that they be in writing.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Any dispute about the App will be handled in the state or federal courts located in Harris County, Texas, unless the law of your state gives you a right to bring it where you live.
Under California Civil Code Section 1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 N. Market Blvd., Suite S-202, Sacramento, CA 95834, or by phone at (800) 952-5210.
These Terms, together with any written agreement you sign with our brokerage, are the full agreement between you and us about the App. If any part is found unenforceable, the rest stays in effect. Our not enforcing a term is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours as part of a reorganization or sale of the business. Sections 3, 5, 11, 12, 13, and 16 through 28 survive after you stop using the App.
